On February 8, 2016, Noranda Aluminum Holding Corporation and all of its wholly owned direct and indirect subsidiaries filed voluntary petitions to initiate a court supervised process under Chapter 11 of the United States Bankruptcy Code in the United States Bankruptcy Court for the Eastern District of Missouri. The cases were before the Honorable Barry S. Schermer, and were jointly administered under Case No. 16-10083.

On February 19, 2016, the Office of the United States Trustee appointed an Official Committee of Unsecured Creditors (the “Committee”). The members of the committee are: (i) Artisan Contracting, LLC; (ii) Delaware Trust Co.; (iii) Mexichem Fluor Comercial, S.A de C.V.; (iv) Pension Benefit Guaranty Corp.; (v) Rain CII Carbon LLC; (vi) Steward Steel, Inc.; and (vii) United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union (United Steelworkers or USW).
The Committee is represented by Lowenstein Sandler LLP as its lead counsel and Spencer Fane LLP as its co-counsel.
Committee Omnibus Objection
On May 5, 2016, the Committee filed a motion to file under seal (“Motion to Seal”) the Committee’s omnibus objection to the (a) Debtors’ motion for an order authorizing and approving the Debtors’ (i) Key Employee Incentive Plan; (ii) Key Employee Retention Plan; and (iii) 2015 Compensation Plan; and (b) the Debtors’ motion for an order authorizing and approving the Debtors’ Modified Senior Management Severance Program for Non-Insider Employees (the “Omnibus Objection”). In the Committee’s Motion to Seal, the Committee indicated that it would make available for review on this website a redacted copy of the Omnibus Objection.
