Important Information & Dates

Title III of the Puerto Rico Oversight, Management, and Economic Stability Act ("PROMESA") provides a means for a covered territory (such as the Commonwealth) that has encountered financial difficulty to work with its creditors to adjust its debts. To that end, certain sections of the United States Bankruptcy Code, 11 U.S.C. § 101 et seq., are incorporated and made applicable to cases under title III of PROMESA. During the Title III Case, the Commonwealth will remain in possession and control of its property, and will continue to maintain its functions and provide services for the benefit of the citizens of Puerto Rico.

General FAQs about the Commonwealth of Puerto Rico’s Title III Cases

On September 27, 2019, the Financial Oversight and Management Board for Puerto Rico (the “Oversight Board”) filed a voluntary petition for relief for Puerto Rico Public Buildings Authority (“PBA”), thereby commencing a sixth case under PROMESA. PBA’s case is jointly administered with the Commonwealth’s and related entity cases under Case Number 17-03283.

In addition to filing PBA’s Title III case on September 27, 2019, the Commonwealth, ERS, and PBA filed their Disclosure Statement and Plan of Adjustment (together the Disclosure Statement and Plan of Adjustment are the “Commonwealth DS and Plan”) under Title III of PROMESA. The Commonwealth, ERS, and PBA have not yet filed a motion seeking the Court’s approval of these documents. Information relating to the motion will be posted on this website as it becomes available, and notice of the motion and related documents will be provided in the manner and form directed by the Court.

Concurrent with its efforts to move forward with its plan for the adjustment of its debts, the Commonwealth and ERS have identified and objected to claims which they contend were not properly asserted against them. You can view these objections by clicking here.

In addition to filing the Commonwealth Plan and DS, a little over a year ago, on October 19, 2018, COFINA filed its motion seeking approval of its Disclosure Statement and Plan of Adjustment under Title III of PROMESA with the District Court. On November 29, 2018, the District Court approved COFINA’s Second Amended Disclosure Statement and solicitation procedures. The Bankruptcy Court entered an order confirming COFINA’s Third Amended Plan on February 4, 2019. Thereafter, on February 12, 2019, the Effective Date of the Third Amended Plan occurred, and the Third Amended Plan was consummated. El Título III de la Ley de Supervisión, Administración y Estabilidad Económica de Puerto Rico (Puerto Rico Oversight, Management and Economic Stability Act, «PROMESA») prevé un mecanismo para que un territorio comprendido (como es el Estado Libre Asociado) con dificultades financieras para trabajar negocie con sus acreedores un ajuste de sus deudas. Para tal fin, determinadas secciones del Código de Quiebra de los Estados Unidos, 11 U.S.C. § 101 et seq., se incorporan y hacen aplicables a los casos al amparo del Título III de la Ley PROMESA. Durante el Caso al amparo del Título III, el Estado Libre Asociado mantendrá la posesión y el control de sus bienes, y continuará desempeñando funciones y prestando servicios en beneficio de los ciudadanos de Puerto Rico.

El 27 de septiembre de 2019, la Junta de Supervisión y Administración Financiera para Puerto Rico (la «Junta de Supervisión») presentó una solicitud de quiebra voluntaria para la Autoridad de Edificios Públicos (Public Buildings Authority, «PBA») de Puerto Rico, e inició de ese modo el sexto caso al amparo de PROMESA. El caso de la PBA se administra conjuntamente con el Estado Libre Asociado y los casos de entidades relacionados con el Número de Caso 17-03283.

Además de presentar el caso al amparo del Título III de la PBA el 27 de septiembre de 2019, el Estado Libre Asociado, el Sistema de Retiro de los Empleados (Employees Retirement System, «ERS») y la PBA presentaron la Declaración Informativa y el Plan de Ajuste (la Declaración Informativa y el Plan de Ajuste son conjuntamente «la Declaración Informativa y el Plan del Estado Libre Asociado») en virtud del Título III de PROMESA. El Estado Libre Asociado, el ERS y la PBA todavía no presentaron una moción para que el Tribunal apruebe estos documentos. La información relacionada con la moción se publicará en este sitio web ni bien esté disponible, y se enviarán notificaciones y documentos relacionados en la forma indicada por el Tribunal.

Simultáneamente a sus esfuerzos por avanzar con el plan de ajuste de sus deudas, el Estado Libre Asociado y el ERS han identificado y objetado reclamaciones que, según afirman, no han sido formuladas correctamente contra dichas entidades. Puede hacer clic aquí.

Además de presentar el Plan y la Declaración Informativa del Estado Libre Asociado, hace un poco más de año, el 19 de octubre de 2018, la Corporación del Fondo de Interés Apremiante (Puerto Rico Sales Tax Financing Corporation, «COFINA») presentó ante el Tribunal de Distrito su petición para que se apruebe la Declaración Informativa y el Plan de Ajuste al amparo del Título III de la ley PROMESA. El 29 de noviembre de ese mismo año, el Tribunal de Distrito aprobó la Segunda Declaración Informativa Modificada de la COFINA y el proceso de solicitud. El Tribunal de Quiebras dictó una resolución que confirma el Tercer Plan Enmendado de la COFINA el 4 de febrero de 2019. Con posterioridad, el 12 de febrero de 2019, llegada la Fecha de Entrada en Vigencia del Tercer Plan Enmendado, este quedó formalizado. The District Court has extended the deadline for filing proofs of claim against the Debtors to June 29, 2018 at 4:00 p.m. (Atlantic Standard Time).

All known creditors of the Debtors were previously sent notice, by mail, of the original deadline to file a proof of claim (the "General Bar Date"). Where applicable, creditors also were also sent a customized proof of claim form. The fact that you received notice of the General Bar Date does not mean that that you have a claim against the Debtors or that the Debtors believe that you have a claim. In addition, certain parties are not required to file a proof of claim. Please refer to section 2 of the notice you received in the mail to determine whether you are required to file a proof of claim. Proof of claim forms may be filed against the Debtors by first class mail, overnight courier, hand delivery, or electronically, through this website. For additional information on filing a proof of claim form, please see section 6 of the notice you received in the mail or click on "Submit a Claim" above.

El Tribunal de Distrito ha extendido el plazo para presentar su evidencia de reclamación contra los Deudores hasta el 29 de junio de 2018 a las 4:00 p.m. (Hora estándar atlántica).

A todos los acreedores conocidos de los Deudores se les envió previamente un aviso, por correo, del plazo original para presentar su evidencia de reclamación (la "Fecha límite general"). También a algunos acreedores se les envió un formulario de prueba de reclamación personalizada.
